General

1. TITTOS grants the participants free access to the offer of services on this Website on the basis of the following terms and conditions of use.
2. The offered services are free. There is no right of use of the services or of placement of individual articles.
3. The participant is aware that in the course of the transfer of data via the Internet, the transferred data can be intercepted and diverted by third parties. The participant is prepared to accept this risk when he or she transfers data via the Internet. TITTOS is not liable for this risk.
4. TITTOS logs each IP address and makes use of cookies. The cookies simplify the functioning of TITTOS. The cookies also allows for recruited friends and acquaintances to be assigned to the recruiting participant's account.
5. The participant expressly accepts the use of their data. The participant may demand the removal of its data at any time. The data will be only used for the fulfilment of the contract and will be deleted upon termination of the contract.

Entries

1. The number of entries is not unlimited. TITTOS has the subsequent right to limit the number of entries, if the functionality of the service is impaired.
2. The presented statements and information of the participants are not edited. However, TITTOS maintains the right to exclude certain articles from publication, if the form or contents appear to be inappropriate.
3. The participant confirms that his or her declarations have been made to the best of his or her knowledge. The participant accepts the responsibility for the accuracy of the contents when the information is publicized.
4. Should TITTOS determine that an article written by a participant has an illegal content, TITTOS will give the participant a warning notice and immediately remove the article. The same applies in the case that a participant publicizes contents that may defame, disparage or insult a person or a group of persons.
5. Articles that breach valid criminal law are deemed to be illegal.
   Particularly, the participant may not
   - place or publicize statements with politically extreme, racist, criminal, pornographic, or insulting contents;
   - place or publicize articles which violate industrial property laws such as intellectual property rights, the right to the use of a name and trade mark rights;
   - place or publicize articles which call for a boycott or for a breach of contract; or
   - place or publicize articles which represent commercial advertisement for a particular business establishment.
   Further, it is not permitted to place frames or links or computer programs without the explicit written permission of TITTOS.
6. The participant will indemnify TITTOS from all civil claims, which arise due to a violation of the above-mentioned regulations. In the case of a warning notice or an official order, TITTOS will remove the objectionable article and demand a statement of position from the concerned participant. The participant may implement all possible legal defenses in agreement with TITTOS. However, the participant will carry all costs of the prosecution.

1. An insertion of Internet Links will be allowed only if in the course of an examination ex aequo et bono and within the limits of recognition with virtual certainty, it can be assumed that there are no contents presented, which are punishable, endanger the protection of children and young persons or otherwise illegal. If despite careful examination, it cannot be guaranteed that the linked individual website does not contain contents, which are punishable, endanger the protection of children and young persons or otherwise illegal due to direct or indirect connections to other websites, TITTOS will not be held liable.
2. As soon as TITTOS is informed of this situation, TITTOS will withdraw the link immediately.

Warranties and Liability

1. TITTOS is only responsible for contents of third parties placed by a participant, if TITTOS has knowledge of the contents and/or link and it is technical capable and reasonable to hinder the dissemination.
2. The services are cost-free. Therefore TITTOS is only liable a breach of duty with intent or gross negligence. The liability for the assertion of damages for bodily harm or injury to health shall not be affected.
3. The same limitation of liability applies to the assertion of consequential damages.
4. The limitation of liability also applies to damages a participant of the information service incurs due to the use or non-use of the offered information, due to the use of the wrong or incomplete performance of the service, tort, the impossibility of performance, faulty contractual performance or default.
5. TITTOS expressly distances itself from spamming. Members who attempt to canvass and/or recruit others for TITTOS by spamming will be banned as soon as their practice is uncovered. In cases of extreme suspicion, their membership will be cancelled. Money already earned will be forfeited.
6. Members who are suspected of manipulating data in any way, trying to automate the reloading of the TITTOS home page, registering more than once with an (existing or non-exisiting) identity, trying any other possible means to manipulate their account in a non-legitimate manner will immediately be banned and have their membership cancelled when proof of their offence is provided. Should such manipulations (commonly known as "faking") be proved, TITTOS reserves the right to take legal steps such as computer manipulation and/or civil action (compensation).

Transfer of the Right of Use

TITTOS will receive the non-exclusive, worldwide right of use, dissemination and modification of the contents for an unlimited period of time upon placement of the contents.

Data Protection

1. All personal data, which TITTOS receives from the participant is strictly confidential and used only for the completion of the contractual obligations. A transfer of the data to third parties is only allowed with express permission of the participant.
2. Personal data is modified and stored exclusively for the completion of the contract.
3. The participant has the right to be informed of his stored personal data any time.
4. Further, the participant has the right to demand the deletion of his personal data at any time. However, in this case, the participant will lose his right to use the system.

Term of the Contract/Termination of the Contract

1. The contract is concluded for an indefinite period of time. Either party may cancel it at any time.
2. The contract regarding the transfer of the right of use (§ 5) may not be terminated unless the participant names a ground for the cancellation, which would justify an extraordinary termination of the contract.
3. Each person or enterprise may register once only. This limit is also applicable to the forum registration. Each user may only use their own account. The registration or shared use of another user's account is strictly forbidden!

Earn money, payout of revenue shares and income

1. The following information can be found on the appropriate pages in the community and on earn money with TITTOS The current compensation for the PayRate (Lucky link), the compensation for the recommendation of active members, the participation on earnings of recruited members or incomes of added or recruited service providers and the minimum payout limit determined by TITTOS. In each case these conditions are valid until the end of each quarter. At the beginning of a new quarter a new agreement will be announced on the pages specified above. If a participant does not accept the latest regulations, the possibility of canceling the membership exists.

3. The user agrees that, in the event of excessive participation or abuse of the system, the paid views (Lucky Link) per day may be limited.
4. Scripts and programs of any kind that automate the reloading of the website, are forbidden and will result in the immediate termination of the account.
5. The current payout limit, as well as the payout conditions and possible payout fees, are specified on the Payout page in the community and in the column Earn money with TITTOS. As soon as this amount is reached, the user may request their payout. Account balances which were not paid out in a particular month will be transferred to the following month. The current account balance is accessible at any time.
6. Self-evaluations are in contravention of the mentioned point "Entries, 1" and the user concerned is required to reimburse these funds (including already paid income shares from other members). In the event of an existing account, TITTOS reserves the right to charge the amount to this account.

Other

1. These terms and conditions regulate all rights and obligations of the contractual parties. Modifications and supplementary additions must be in writing and refer to this contract to be valid and signed by both parties.
2. Deviations by the participant are only valid if TITTOS has agreed to these in writing.
3. The regulations of this contract and supplementary the laws of the Federal Republic of Germany are applicable to this contractual relationship.
4. Should the participant be a merchant as defined by the commercial code of the Federal Republic of Germany (Handelsgesetzbuch), a juristic person under public law or a public separate asset, the place of performance and place of jurisdiction for all disputes arising out of this contractual relationship is Cape Town, Republic of South Africa.
5. Should individual regulations of this contract not be legally valid or should a regulation lose its legal validity due to a later circumstance or should an omission in this contract be discovered, then the legal validity of the other regulations shall not be affected. In place of the invalid contractual regulation or for the closure of the omission, an appropriate regulation that comes as close as possible to the regulation desired by the parties had they been aware of this situation, shall apply.
